FAQs
Sentences imposed on or after August 1, 2015 (including re-sentences),
How can I get notified if an AIC's release date has changed?
The Oregon Offender Search is the official site to see an offender's release date.
Victims can also subscribe to VISOR, which provides near-real-time (every two hours) notifications if a release date has changed, an offender has moved from one facility to another, or an offender has been released.
Will all sentences be reviewed?
DOC is reviewing sentences that meet specific criteria, including:
Reviews will be prioritized based on upcoming release dates.
Who do I contact if I don't agree with the results of the recalculation?
DOC staff cannot provide legal advice. Contacting an attorney or the sentencing court would be the first step.
Who will be notified if the sentence changes?
The AIC will receive a notification if their sentence changes.
The Oregon Offender Search will update with the new release date.
VISOR will notify subscribers of changes that result in immediate release or changes to the release date. VISOR sends notifications every two hours.
What caused DOC to miscalculate the sentences to begin with?
This recalculation is not the result of DOC making a mistake. The recalculation is prompted by a new court ruling that re-interprets the intent of existing law.
Sentences are often recalcuated during the normal course of business based on new laws passed by the legislature every year and by new court rulings. Recalculating a sentence in and of itself is not unusual -- what is unusual is this circumstance is the large number of AICs the court ruling applied to (everybody sentenced after 2015).
Who do I contact to request that an AIC has their sentences recalculated?
A request does not need to be submitted. If a sentence qualifies, it will be reviewed automatically.
Who do I contact to get an update on an AICs recalculation results?
DOC staff cannot provide individual status updates. An AICs projected release date is available on the Oregon Offender Search.
If an adjustment is made to the release date, the AIC will receive a notification.
How do I get an amended judgment from the court?
You would need to contact the sentencing court or the sentencing county's district attorney.
What needs to be in the court's judgment?
The court must include language in the judgment that expressly allows pre-sentence TSC during service of a previously imposed sentence something similar to: “The defendant shall receive presentence incarceration credits pursuant to ORS 137.370(4).”
DOC is not able to assume the intent of the judgment if it is not expressly written.
Why aren't sentences prior to August 2015 being reviewed?
Prior to August 2015, sentencing guidelines did not allow for this type of time served credit. A sentence prior to August 2015 couldn't have intended to include this time served credit because the credit did not exist yet.
